BBB Advises on Estate Planning

The Better Business Bureau advises people to create an estate plans if they own something of value.

An estate plan can be as simple as drafting a will or as complex as setting up a trust and a living will. At the least, anyone who has assets to pass on to specific individuals should create a will, the bureau advises. A will can allocate assets as well as establish guardianship of children.

Doing the estate planning is the simple part. Standing up for it when a guardianship is threatened isn't nearly as easy.

I think the Better Business Bureau is dreaming of what should be, not reality.

Guardianship can and in most cases, will void all previously executed legal documents giving the guardian or conservator more powers than most people want to acknowledge or believe.

Shakespeare said it: "The law is an ass."

How do the legislators write laws providing for advance directives, and then write other laws for guardianship which don't clearly mandate compliance by the court with those directives, or the need to prove execution and validity through meaningful due process of law, if challenged?

Too many judges fail to solicit whether or not there are such advance directives, or simply roll over them!
