Gary Harvey Court Records Sealed!

State Supreme Court Judge Judith O'Shea has sealed the court records in connection with a Horseheads woman's battle for guardianship of her husband.

Sara Harvey appeared before O'Shea in September in her continued efforts to obtain legal guardianship of Gary Harvey, who was severely brain injured in a January 2006 accident and has been in a persistent vegetative state.

Sara Harvey said her husband is suffering under significantly inadequate care provided by the Chemung County Nursing Facility and wants to get better medical care for him.

Following the September court appearance, a decision was anticipated from O'Shea within 60 days on whether there was enough evidence to schedule a hearing.

On Friday, the court clerk's office said the record on the case has been sealed and no information could be released.

Harvey said Friday that she could not disclose what the judge said because the records were sealed.

Well, well, well, we must ask ourselves who sealing the records protects.

Sara Harvey is an outspoken advocate for her husband.

The county tried to starve and dehydrate him to death earlier this year and would have done so had it not been for Sara Harvey.

Looks pretty obvious to me!

Sealing the records is always a red flag that there's wrong doing being covered up.

State Supreme Court Judge Judith O'Shea might be regretting her decision to seal records. One has to ask: WHY? What is being hidden? And, who is being protected?

Gary Harvey was a person turned into a product. I am stunned and disgusted by the power and control mongers who will stay on the wrong course to prove a point. I hope this wrong course gets them into a big hole with no way out.

Thanks for keeping this important case in the news for others to witness what could be in their future and if that doesn't scare the hell out of every person, then nothing will.

I don't believe that sealing the court record would/should/could stop Sara Harvey from speaking about the case.

we all read of Sara's fight to bring her husband, Gary, home. it's mind boggling to try and understand the county's keeping this from happening. it has to be a money thing? and it's costing tax payers, his insurance company, lawyers for both sides, court costs, and every one is benefiting except Sara and Gary.

Gary was my boss at T&B for several years. such a nice man. a kind man. wonderful to work with and for. and i think i know him well enough, that if he could talk, he would "want to be home" with his wife and many friends that could visit and not be poked and prodded by those who don't really care. and after their day is done, they go home to their family, Gary forgotton. out of sight, out of mind....

it's just a heartless situation. makes to wonder who in their right mind would want a family member of theirs to go through this for 3 years like Sara and Gary have done.

someone has to be profiting from all this? and it's surely not the Harvey's. i have sent Garys plight to those in government offices but it seems they don't care either?

my heart is with you Sara. and i dearly love Gary. you are both in my prayers.
